Michigan Expungement & Clean Slate
A criminal record can follow you for decades — blocking job opportunities, housing applications, professional licenses, and educational programs. Michigan’s Clean Slate legislation dramatically expanded who qualifies for expungement, including certain assaultive crimes and multiple felonies.
At Brandon McNamee PLC, we help clients throughout Port Huron and Michigan’s Thumb region take advantage of these expanded eligibility rules.
What Can Be Expunged in Michigan?
Felony Convictions
Michigan now allows expungement of up to three felony convictions. Certain serious felonies remain ineligible, but the list of eligible offenses has expanded significantly.
Misdemeanor Convictions
You may be able to expunge an unlimited number of misdemeanor convictions — a dramatic change from the old law.
Marijuana Offenses
Many marijuana-related convictions that occurred before legalization can be expunged.
Traffic Offenses
Certain traffic misdemeanors, including some OWI/DUI convictions, may now be eligible depending on the specific charge and your overall record.
What Cannot Be Expunged
Life felonies, most criminal sexual conduct convictions, offenses involving minors in certain categories, human trafficking, and terrorism-related offenses generally remain ineligible.
How Expungement Changes Your Life
Employment: Expunged convictions won’t appear on standard background screenings. You can answer “no” when asked about convictions on most job applications.
Housing: Removes a major barrier to securing quality housing for you and your family.
Professional Licensing: Opens doors for healthcare, education, real estate, and trade licenses.
Education & Financial Aid: Restores access to programs and aid restricted for people with criminal records.
Peace of Mind: Move forward without the weight of past mistakes defining who you are today.
How the Expungement Process Works
Step 1: Free Record Review
We obtain and review your complete criminal record to identify every conviction that may be eligible for expungement.
Step 2: Eligibility Analysis
We determine which convictions qualify under current Michigan law, considering timing requirements, total convictions, and other factors.
Step 3: Petition Preparation
We prepare a detailed expungement petition including legal application, supporting documentation, and evidence of rehabilitation.
Step 4: Filing & Prosecution Notice
We file your petition with the appropriate court and serve notice on the prosecuting attorney.
Step 5: Court Hearing
Not all cases require a hearing — some are granted on the written petition alone. If a hearing is required, Attorney McNamee represents you before the judge.
Step 6: Order & Record Clearing
Once granted, we ensure the court order is properly distributed to Michigan State Police, FBI, and the arresting agency so your record is updated everywhere.

Misdemeanors: typically 3 years after completion of your sentence. Felonies: typically 5 years. Some marijuana offenses have shorter or no waiting periods.
Will an expunged record still show up on background checks?
Once properly expunged, it should not appear on standard criminal background checks. You’re legally entitled to deny the conviction in most circumstances.
Can a DUI/OWI be expunged?
Michigan has expanded eligibility for OWI expungement. A first-offense OWI may be eligible under certain conditions. Learn more about DUI defense.
Can I expunge multiple convictions at once?
Yes. Michigan law now allows multiple convictions to be expunged, and we can file petitions for all eligible offenses simultaneously.
How long does the process take?
From filing to final order, typically 2-4 months depending on the court’s schedule and whether the prosecutor objects.
